These Terms and Conditions govern the commercial relationship between the seller, WINEUPONATIME, and the buyer. They are an integral part of the conditions of use.

By ordering on this website, the purchaser acknowledges having read and accepted without reservation the CGV. In case of disagreement with the present CGV, the buyer abstains from ordering on this site.

We reserve the right to change these GTCs at any time and without notice by publishing a new version of these GTCs on this site.

1. Legal age for sale of wines and spirits

The customer confirms by his order that he is at least 16 years old for wines and at least 18 years old for spirits. The sale of wine to persons under 16 years of age and the sale of spirits to persons under 18 years of age are prohibited by law. Terms of sale of alcohol in Switzerland.

2. Availability of wines and spirits

The list of products is subject to availability. In case of unavailability of the ordered product(s), the buyer will be informed.

Some products are available in very limited quantities or even in single copies.

3. Application of Pricing

The prices of the products for sale on WINEUPONATIME are indicated in Swiss Francs (CHF), all taxes included (TTC), from Martigny.

4. Visuals

The images and visuals on the site are non-contractual. We try as much as possible to present in images the bottles that you wish to acquire. But this is difficult, even impossible in certain cases (case of 12 bottles). It may take several years between the date the photo was taken and the date the bottle was sold. We keep the bottles and their original boxes or cases in a humid cellar, it is possible that traces, stains or degradation appear over time.

We take into account the condition of presentation of the bottles when we establish the prices, there may be labels in different conditions for the same reference. It is the buyer's responsibility to request recent images of the bottles he wishes to acquire before placing his final order. No complaints relating to the aesthetics of the bottle will be accepted.

The absolute priority goes to the conservation of the wines. The level of the wines in the bottle and the condition of the corks are our main concern. We do not sell wines whose levels are too low, whose necks show traces of dripping or presenting a risk of degradation (cloudy wine). We consider that customers buy the bottles for the content and not the container.


5. Payment of Orders

Orders are payable in advance via the WINEUPONATIME website, by credit card, bank transfer or Paypal payment.

If the method of payment chosen is bank transfer, the items ordered will be booked until the payment is received (maximum 7 days after your order). Please note that depending on the bank, it takes between 2 and 4 working days for your payment to be taken into account.

The goods remain our property until the invoice is paid in full.

6. Conditions of delivery

The shipping costs are calculated according to the weight of the order according to the current postal rates, can be added in addition to the handling and/or packaging fees.

For shipments by La Poste, in order to preserve at best the condition of the wines ordered, we can, with your prior consent, postpone the shipment in case of unfavourable weather (high heat or freezing).

Customs / VAT charges inherent to your receiving country may apply to you. These charges are the buyer's responsibility. We invite you to find out about the terms of application of taxes in your country.

Once the customer's order has been shipped to the address provided by the customer in "delivery address" and delivered to the carrier, WUAT transmits the tracking number of the package to the buyer. It is the buyer's responsibility to ensure the tracking and proper reception of his package, whether at his home or at a pick-up point if he was notified. For export, customs can contact the buyer for additional information. Wine Upon A Time can not be held responsible for the customer's default or a postal error and reserves the right to withhold management fees and compensation if the package should be returned to it.


7. Right to revoke and claim against the order

No claim on any stuffed or deviated wines will be accepted.

The order, regardless of the method of payment chosen by the buyer, is firm and final. The purchaser has no right to withdraw or revoke his order and therefore cannot return the object of his order. No exchanges or refunds will be granted.

After the customer has concluded the order, WINEUPONATIME is entitled to cancel an order, which has not yet been delivered, at any time and without having to tell the customer why. In this case, the customer will be reimbursed by ORANGERSHOP by transfer or purchase order at the free choice of WINEUPONATIME.

8. Security and Data Protection

WINEUPONATIME respects the privacy of its customers and the relevant provisions of Swiss data protection law.

wineuponatime.com is a commercial name owned by GRECOR SARL established Chemin de la praille, 1920 Martigny.

The purchaser consents to the personal data that he has recorded of his own volition; are saved by the site and can be used for the communication of advertisements, for example, and until it decides to revoke this function.

The secure backup of personal data will be respected by WINEUPONATIME in accordance with the applicable provisions of Swiss data protection law. However, this protection cannot be guaranteed.

The purchaser’s personal data will not be communicated to any third party without his prior consent, unless a court decision requires it.

9. Intellectual Property

All elements of the site are owned by WINEUPONATIME. No data can be used without our prior consent.

10. Validity of offers

The list of products presented on the website is subject to availability.

We reserve the right to modify at any time and without notice all of our products as well as their prices and conditions.

11. Other provisions

Relations between WINEUPONATIME and its customers are subject to Swiss law.

Upon validation of your order, you agree to the above general conditions, and you confirm that you have provided the exact information about yourself.

12. Applicable law

Swiss substantive law is applicable to these terms of use. Any dispute is subject to the exclusive jurisdiction of the courts of the Republic and Canton of Valais.
